A commercial vehicle according to the Federal Motor Carrier Safety Administration (FMCSA) has to fall under a certain category that can range from its gross vehicle weight rating (GVWR) to even its seating capacity and usage. Continue your commercial vehicle research today with Jim Ellis Commercial Division where we’ll help you answer, “What is a commercial vehicle?”

What Is a Commercial Vehicle According to the FMCSA?

So, why bother asking, “What is considered a commercial vehicle?” Knowing what a commercial vehicle is can help you better understand if you need to get a commercial vehicle driver’s license (CDL) before you add a commercial vehicle to your fleet. Depending on your local laws, some commercial vehicles will have to follow special rules and road regulations, thus requiring you to need a special driver’s license before you can operate it.

To calculate a vehicle’s GVWR, you need to know its curb weight and its maximum payload capacity. Curb weight is the weight of the vehicle with all standard equipment and fluids, but no passengers or cargo. Maximum payload capacity is the amount of weight the vehicle can carry in addition to its curb weight. To calculate GVWR, simply add the two together.

With that being said, local laws can vary, so it’s best to do your research before you decide to purchase a commercial vehicle. To help you better answer the question, “What is a commercial vehicle according to the FMCSA?”, we’re going to go over some of their rules regarding commercial vehicles. If the vehicle falls under any of these conditions, the FMCSA considers it a commercial vehicle:

  • GVWR is over 10,001+ pounds.
  • Transports over 15 passengers (including driver) for free.
  • Transports over 8 passengers for compensation.
  • Transports hazardous materials in amounts where the vehicle needs to be placarded.
